Bolivia: Presidente Evo Morales considera que debería protegerse el trabajo infantil en el país y no buscar eliminarlo

El presidente Evo Morales consideró el lunes 23 de diciembre de 2013 que debería protegerse el trabajo infantil en el país y no eliminarlo, porque a su juicio- crearía un oficio clandestino, en alusión en referencia al proyecto del nuevo Código Niña, Niño y Adolecente, que prevé será aprobado en 2014.

En una conferencia de prensa en Palacio de Gobierno, el Jefe de Estado dijo que la actividad laboral de los niños y adolescentes “no debería prohibirse, sino debería protegerse”.

“Vamos a eliminar (el trabajo infantil) y es dejar sin trabajo, pero va a crecer un trabajo clandestino. Por más que se diga que por ley hay que eliminar el trabajo de niña o niño no se va a eliminar, va a haber un trabajo clandestino y es peor tener un trabajo clandestino”, sostuvo.

El Mandatario, al recordar su dura infancia en el altiplano, admitió que algunos niños y adolescentes del país deben trabajar por necesidad, para ayudar a sus familias, en ciertos casos por la orfandad, sin embargo, dijo que el trabajo infantil no debería ser explotado, hecho que debería ser ‘cuidado y controlado’.

Además, afirmó que eliminar el trabajo infantil también es quitar a los niños, niñas y adolescentes la “conciencia social”.

“A veces la necesidad te obliga a trabajar, lo más importante y coincidimos con todos los niños, cuando uno trabaja desde pequeño tiene más conciencia social, a veces cuando converso con algunos jovenzuelos, el joven sabe todo y más que cualquier persona mayor”, dijo el Jefe de Estado en conferencia de prensa dictada en Palacio de Gobierno.

Les décla­ra­tions et réso­lu­tions de l’Organisation des Nations Unies qui qua­li­fient le régime d’apartheid de « crime contre l’humanité » et l’adoption en 1973 de la Convention inter­na­tionale pour l’élimination et la répression du crime d’apartheid vont donner un appui consi­dé­rable aux mou­ve­ments anti-​​apartheid.

Les mili­tants du mou­vement de soli­darité vont en effet pouvoir s’y appuyer pour demander à leurs gou­ver­ne­ments res­pectifs l’application des sanc­tions glo­bales et obli­ga­toires, surtout à ceux des pays qui se sont opposés ou se sont abs­tenus lors du vote pour l’adoption de ces réso­lu­tions, en par­ti­culier les USA, la Grande-​​Bretagne, Italie et la France.

J’ai l’impression que les militantes europeens ont la mémoire courte: ils oublient que, pour abattre l’apartheid, le boycott total fut adopté contre l’Afrique du Sud, boycott qui  touchait autant les individus que les institutions. Quand un pays commet des crimes,  viole constamment le droit international et que ses institutions culturelles sont complices,  si vous ne les boycottez pas, vous devenez vous-même complices.

Gustavo Petro : une destitution de trop ! (EELV)

Les écologistes ont appris avec indignation le 9 décembre la destitution du maire de Bogota Gustavo Petro.

En effet, cette destitution ordonnée par le Procureur général Alejandro Ordoñez sous prétexte d’avoir refusé la concession de la collecte d’ordures au secteur privé au profit d’une compagnie publique cache difficilement la manœuvre politique.

Comment invoquer une incapacité à gérer la crise des ordures ménagères comme étant la cause décisive d’une interdiction pour Gustavo Petro à exercer ses fonctions politiques pendant 15 ans ? Comment accepter que le maire de cette mégalopole colombienne soit le seul désigné pour régler l’ensemble des problèmes sociaux de Bogota?

Rappelons que Gustavo Petro a de façon décisive aidé à l’évolution des forces intellectuelles auprès des guerilleros pour faire avancer le processus de paix en Colombie.

Rappelons que son action contre les procédés inhumains pendant la guerre civile restera gravée dans les mémoires de la réconciliation.

Les écologistes en appellent à la justice colombienne, célèbre pour sa rigueur et son indépendance, à revoir au plus vite le jugement du Procureur général Alejandro Ordoñez.

Le remito la carta abierta  promovida por el eurodiputado alemán Jürgen Klute y el eurodiputado catalán Raül Romeva, y co-firmada en total por 18 eurodiputadas y eurodiputados frente a la decisión del Sr. Procurador de destituir al Sr. Gustavo Petro de sus funciones de Alcalde de Bogotá.

En la carta se expresa “nuestra profunda preocupación sobre la decisión de la Procuraduría General de Nación de destituir e inhabilitar por 15 años al alcalde de Bogotá, Gustavo Petro. El Alcalde Petro fue elegido por una mayoría de votos y tiene un mandato popular en la ciudad más importante de Colombia.

Es sabido que en el marco de la Corte Interamericana sobre Derechos Humanos y del Pacto Internacional de Derechos Civiles y Políticos, no es posible que un funcionario destituya un gobernante elegido popularmente. Concretamente, la Convención Interamericana de Derechos Humanos establece que los derechos políticos pueden ser restringidos por vía de sanción solo cuando existe condena, por un juez competente, en un proceso penal. Lo cual no es el caso de Gustavo Petro.

Las actuaciones de la Alcaldía de Bogotá en la puesta en marcha de un nuevo esquema de aseo en la ciudad y la inclusión de la población recicladora en un sistema antes monopolizado por la empresa privada, han tratado de convertir a esta ciudad en una Bogotá más Humana. Si bien es cierto que ha habido fallos en la implementación de este nuevo sistema, la destitución e inhabilitación del Alcalde nos hacen pensar que una persecución política podría estar detrás de las razones invocadas sobre su gestión para su destitución.

Acompañamos las voces que propenden por el fortalecimiento de la democracia y de la institucionalidad en Colombia, y saludamos las declaraciones del Ministro de Justicia de Colombia en el sentido de “revisar la norma constitucional que permite inhabilitar a personas que han sido elegidas por voto popular”.

European Parliament: not enough progress as regards human rights in Colombia

MEPs from the Subcommittee on Human Rights expressed concerns about the human rights situation, which seems to have worsened in Colombia since the signing of the free trade agreement, in a debate held on Wednesday November 27. Particularly worrying were the issues of land restitution in rural areas and labour conditions for the working classes, they said.

Speakers agreed that more can be done using the free trade agreement as a tool for improving the lives of trade unionists, who regularly receive death threats and persecution at the hands of paramilitary organisations. However, the longer-term solution can only come from Colombian democratic society, it was said.

Guest speakers: Juan Carlos Monge, Deputy Representative of the United Nations High Commissioner’s Office for Human Rights in Colombia, Diego Martínez, Director of the Permanent Committee for the Defence of Human Rights and national spokesperson of MOVICE, Winston Gallego Pamplona, from the Colombia – Europe – United States Coordination Group.

I met Mep Pino Arlacchi on june at the European Parliament (see photo) and we talk about human rights in Colombia; Mep Arlacchi as under secretary-general of the United Nations in 1997-2002, he led its fight against terrorism, organised crime and drug trafficking, and was one of the driving forces behind the Palermo convention (officially, the UN Convention against Transnational Organized Crime).

“We the Members of the European Parliament express our deepest concern about the land grabbing process currently taking place in Colombia. Large companies, including several multinationals, have been buying land in an area in the eastern part of the country known as the high plains (Altillanura), with the objective of developing agribusiness projects.

This process violates Colombian law, which states that public lands should be assigned to poor rural workers and subsequently cannot be assembled in areas larger than those given to them. We are concerned about the social fabric of the area since the purchase of land by large corporations removes communities from their traditional territories, also inhabited by indigenous groups. In addition, projects in these areas can have serious environmental consequences, affecting a fragile ecosystem characterized by high biodiversity and water resources.

European companies such as Poligrow have been involved in this land grabbing process. Poligrow bought 13781 acres, three times the legal limit. Its lands are located in Mapiripán, a town known for having been the scene of acts of severe violence such as the massacre perpetrated by paramilitary groups in 1997.

It should also be noted that other European nations have been used by these land grabbers to avoid controls of their investments. A case in point is Riopaila Castilla, a Colombian sugar producer who created an investment fund in Luxembourg to take over farms bought by a series of shell companies created with the aim of violating legal constraints on land concentration”.

I soldatini delle mafie

Il parlamento europeo ha scritto una pagina importante nella lotta alle mafie, ha detto Rita Borsellino, un primo passo per contrastare quelle organizzazioni criminali a livello transnazionale. Ora spetta alla Commissione non vanificarlo con l’attuazione di misure concrete. Maggiore attenzione va posta invece ai bambini e agli adolescenti che le mafie e il narcotraffico utilizzano a livello globale. In Puglia, Campania, Calabria e Sicilia la criminalità organizzata può contare su un esercito di 1.721 piccoli soldati: bambini di dieci anni e mezzo arruolati dai clan.

“Il 23 ottobre il Parlamento europeo ha scritto una pagina importante nella storia della lotta alle mafie e il crimine organizzato in Europa. Il rapporto contro la criminalità organizzata, la corruzione e il riciclaggio che è stato approvato a Strasburgo a larghissima maggioranza, infatti, rappresenta il primo concreto piano d’azione dell’Ue per contrastare questi fenomeni a livello transnazionale”. Lo ha detto Rita Borsellino, eurodeputato del gruppo dell’Alleanza Progressista di Socialisti e Democratici S&D, commentando l’approvazione da parte del Parlamento di Strasburgo del rapporto sulla criminalità organizzata.  La risoluzione è stata approvata con 526 voti a favore, 25 contrari e 87 astensioni.

“Come relatrice per gruppo S&D, sono molto soddisfatta del risultato raggiunto. Mi preme pero sottolineare che si tratta di un primo importante passo e che il cammino da compiere per diffondere una cultura della legalità in Europa è ancora lungo.”

“Il testo approvato – prosegue l’eurodeputata- contiene proposte e individua strumenti per contrastare il crimine organizzato e la corruzione: dalla definizione comune di criminalità organizzata all’introduzione del reato di associazione mafiosa, dall’armonizzazione delle legislazioni in materia di riciclaggio all’abolizione del segreto bancario. E poi ancora: il riutilizzo sociale dei beni confiscati, la trasparenza negli appalti pubblici, la lista nera di compagnie coinvolte in reati di corruzione e criminalità organizzata, l’istituzione in tempi brevi del Procuratore europeo, una normativa ad hoc per la protezione dei testimoni di giustizia e delle vittime della tratta, l’ineleggibilità dei condannati per mafia, corruzione e riciclaggio enorme più severe contro i crimini ambientali. Infine, istituisce la giornata europea della memoria e dell’impegno per le vittime della criminalità organizzata che sarà celebrata ogni anno, il 23 ottobre, data dell’approvazione del rapporto. Ora spetta alla Commissione europea – conclude – trasformare al più presto le proposte del Parlamento europeo in azioni concrete senza vanificare il lungo e importante lavoro svolto dalla commissione contro il crimine organizzato”

La problematica  « Children and youth in Organised Armed Violence » colpisce anche l’Europa e in particolare l’Italia.

Ne ho parlato direttamente con Rita Borsellino, nell’incontro al Parlamento Europeo del giugno scorso per porre l’attenzione sul fenomeno dei “bambini/e e adolescenti utilizzati dalle mafie” per citarlo nel Rapporto UE anche nelle sue relazioni con l’America Latina, in primis Messico e Colombia dove arrivano i tentacoli di ndrangheta e mafie italiane.

Belo Sun Mining Project Suspended in Brazilian Amazon

In response to a civil lawsuit filed on November 13th by the Federal Public Prosecutor’s office in the state of Pará (MPF-PA), a federal judge has ordered the immediate suspension of environmental licensing for a massive gold mining project proposed by Canadian-based Belo Sun Mining along the Big Bend (Volta Grande) of the Xingu River until full analysis of effects on indigenous peoples has been carried out within the Environmental Impact Assessment (EIA). MPF also calls for a process of free, prior and informed consultations and consent among local indigenous peoples regarding the project in accordance with ILO Convention 169 and the Brazilian Constitution.

Judge Sergio Wolney stated in his decision that, «the licensing of the mining project without necessary and prior analysis of impacts on indigenous peoples – a fact confirmed by evidence presented in this case – constitutes a serious violation of environmental legislation and indigenous rights.»

According to Wolney an «undeniable fact» is that the mining project, slated for installation in the immediate vicinity of the controversial Belo Monte dam complex, may lead to devastating and irreversible consequences – including synergistic impacts with Belo Monte – for the quality of life and cultural heritage of indigenous peoples and their territories.

For the MPF, granting an environmental license for an additional project with such severe probable impacts without a prior study of its consequences for indigenous populations is inadmissible. The people of the Big Bend of the Xingu will already suffer the worst impacts of Belo Monte as a result of the diversion of 80% to 90% of the Xingu River’s flow to feed the dam’s turbines. The potential impacts of Belo Monte are so severe that the federal environmental agency (IBAMA), when granting a first phase license for the project, established a six-year period to test whether the Big Bend and its people would be able to survive a permanent hydrological deficit and other consequences of diversion of the Xingu river associated with dam construction.

Meanwhile, Belo Sun stated today that it will take all «applicable legal measures to appeal the decision of the Federal Judge and defend the validity and legality of the licensing process.»

20/11/2013 às 15h07A Justiça Federal em Altamira suspendeu o licenciamento ambiental do projeto Volta Grande de Mineração, que a mineradora canadense Belo Sun pretendia instalar na mesma região onde está sendo construída a hidrelétrica de Belo Monte, no rio Xingu, no Pará. A decisão atende a pedido do Ministério Público Federal (MPF) e obriga a empresa a fazer os estudos de impacto sobre os indígenas da região, que são exigidos por lei e até agora não foram apresentados.“A condução do licenciamento ambiental sem a necessária e prévia análise do componente indígena demonstra grave violação à legislação ambiental e aos direitos indígenas”, diz a decisão judicial. A liminar determina a suspensão do licenciamento e a anulação, caso seja expedida, de licença prévia à Belo Sun, “condicionando o licenciamento à elaboração do Estudo de Impacto Ambiental e respectivo Relatório de Impacto sobre o Meio Ambiente do Projeto Volta Grande de Mineração contemplando o componente indígena, devendo ainda seguir as orientações contidas no Termo de Referência elaborado pela Fundação Nacional do Índio (Funai)”.

Ruta Pacifica de las Mujeres Presented Study on Colombia’s Conflict

The Colombian women’s peace organization Ruta Pacifica de las Mujeres presented their study on the country’s conflict this Thursday 15 of  november in Bogota.

The Colombian women’s peace organization, «La Ruta Pacifica de las Mujeres» («The Peaceful Path of Women»), presented the results of their three year long «Truth Commission» this Thursday in Bogota.

The group, which has been working since 1996 for a peaceful resolution to the country´s decades long conflict, embarked on the project with the goal of bringing to light how the conflict has affected women in particular. At a time when peace talks are taking place in Havana, Ruta Pacifica wanted to bring more women into the dialouge.

The national coordinator of the organizatin, Marina Gallego, said today that what makes their study different than others is that it is based in the testimonies of women and as such, it is a statement from the base of communities.

The Ruta Pacifica has been supported in this endevour by the United Nations as well the governments of Spain, Sweeden and non governmental organizations such as Oxfam.
